This Policy does not apply to the personal information of Beauvoir’s employees, representatives, and consultants, or any other person affiliated with Beauvoir, as well as any information that does not constitute Personal Information as defined by law.

The following words and expressions, when they appear with an initial capital letter in the Policy, have the meaning attributed to them below, unless an implicit or explicit derogation in the text:

Personal Information” means any information concerning a natural person which allows them to be identified, as defined by the Act respecting the protection of personal information in the private sector (Quebec) or by any other equivalent law of another jurisdiction. In general, information concerns a natural person and allows them to be identified when it reveals, directly or indirectly, something about the identity, characteristics (for example, abilities, preferences, psychological tendencies, predispositions, mental abilities, character, and behavior of the concerned person) or activities of that person, regardless of the nature of the medium or the form under which this information is accessible (written, graphic, audio, visual, computerized, or other).

Privacy Officer“: The person responsible for the implementation of this Policy, whose contact details can be found in Article 2 of the Policy.

Services” refers to all services offered by Beauvoir, whether offered in person or through the Website and its features, including but not limited to our brand strategy and marketing services, design, ideation and storytelling, graphic design, video production, web development, web hosting, digital performance, our newsletter, our customer service, as well as associated media and documentation (printed or digital) made available to you.

The Privacy Officer is responsible for determining the purposes and means used in the processing of personal information.

2.1. Responsibilities of the Privacy Officer

The Privacy Officer is committed to protecting the personal information collected, not to transmit it to third parties without having informed you, and to respect the purposes for which this information was collected.

Furthermore, the Privacy Officer commits to notifying you in case of rectification or deletion of personal information, unless this results in disproportionate formalities, costs, or procedures for him.

In the event that the integrity, confidentiality, or security of your personal information is compromised, the Privacy Officer commits to inform you by any means.

3.1. Collection of Personal Information

    • connection information and other information about your activities on the Website, such as your IP address, the pages you have viewed, the time and date of your visits, the type of browser you use, the operating system of your device, and other hardware and software information;

Please note that some information, such as your username and profile picture, could be publicly accessible if you comment on our blog posts or other public publications;

In each case, these Personal Information are processed in accordance with the legitimate and necessary purposes listed in Article 3.2 below.

We may communicate your Personal Information to our employees, contractors, consultants, agents, service providers, and other trusted third parties (collectively, the “Service Providers“), who need this information to help us operate our Website, carry out and protect our business activities, or serve you, provided that these Service Providers have previously committed in writing to ensuring the confidentiality of your Personal Information in accordance with applicable laws and our information governance program.

We do not sell, trade, or otherwise communicate your personal information to third parties, except for the following reasons or subject to the exceptions provided by law:

  • Order fulfillment
  • Partnership

3.3.1. Service Providers and Other Third Parties

Although we try to avoid communicating your Personal Information to third parties, we rely on third-party service providers to perform various services on our behalf, such as remarketing, website hosting, and data analysis and storage. We have defined below the cases in which such communication could occur:

  • Google – We use Google Analytics to analyze the audience and traffic on the Website as well as the reCAPTCHA service for security purposes. See their privacy policy.
  • Facebook – We use the platforms and products of Facebook for our remarketing activities, including the development of our clientele and the promotion of our activities and products. See their privacy policy;
  • LinkedIn – We use the LinkedIn platform for our remarketing activities, including the development of our clientele and the promotion of our activities and products. See their privacy policy;

We enter into written contracts with our Service Providers before communicating your Personal Information to them, and we only provide them with the Personal Information necessary to carry out their mandate. As part of these contracts with our Service Providers, we commit to ensuring that the principles set forth in this Policy are respected, and these Service Providers are required to use the Personal Information according to our instructions and solely for the purposes for which they were provided. Moreover, these Service Providers offer us sufficient guarantees regarding the implementation of adequate protection measures that are proportional to the sensitivity of the Personal Information concerned, the purpose of their use, their quantity, their distribution, and their support. When our Service Providers no longer need your Personal Information, we ask them to return or destroy this Personal Information appropriately.

Please note that some of our Service Providers are located outside of Quebec. It is therefore possible that some of your Personal Information may be communicated outside of Quebec. Before communicating Personal Information outside of Quebec, we conduct a privacy impact assessment to evaluate the risks associated with this communication and to determine if the Personal Information concerned will benefit from adequate protection. We will proceed with the communication of the concerned Personal Information with the Service Provider only after obtaining positive conclusions from our assessment and a confirmation that the risks to privacy are minimal.

3.3.2. Compliance with Legislation, Response to Legal Requests, Prevention of Harm, and Protection of Our Rights

We may communicate your Personal Information when we believe such disclosure is authorized, necessary, or appropriate, in particular:

  • to respond to requests from public and governmental authorities, including public and governmental authorities outside your country of residence;
  • to protect our activities;
  • to comply with judicial proceedings;
  • to protect our rights, our privacy, our security, our properties, yours, or those of third parties;
  • to enable us to implement available remedies or to limit the damages we may suffer; and
  • in accordance with applicable laws, including laws outside your country of residence.
3.3.3. Business Transaction

We may share, transfer, or communicate, in strict compliance with this Policy, your Personal Information in the event of a sale, transfer, or assignment, in whole or in part, of Beauvoir or our assets (for example, following a merger, consolidation, change of control, reorganization, bankruptcy, liquidation, or any other business transaction, including in the context of negotiating such transactions). In this case, we will inform you before your Personal Information is transferred and governed by another privacy policy.

3.4. Consent

We will only use your Personal Information for the purposes for which we collected it, in accordance with this Policy. We will seek your consent before using your Personal Information for purposes other than those set forth herein, subject to the exceptions provided by law, including when the new intended use is compatible with the purpose for which the Personal Information was originally collected.

To the extent possible, Beauvoir directly obtains consent from the concerned individual for us to collect, use, and communicate their Personal Information. However, if you provide us with Personal Information about other people, you must ensure that you have duly notified them that you are providing us with their information in addition to having obtained their consent for such communication.

3.5. Retention of Personal Information

Subject to applicable laws, we retain your Personal Information only for the time necessary to achieve the purposes for which this information was collected unless you consent to your Personal Information being used or processed for another purpose. As an indication, the duration of certain information may extend up to 7 years following the end of the Services provided by Beauvoir to you. In addition, our retention periods may be changed timely due to legitimate interests (for example, to ensure the security of Personal Information, to prevent abuse and violations, or to pursue criminals).

4. YOUR RIGHTS

Beauvoir implements a series of reasonable physical, technological, and organizational security measures aimed at adequately protecting the confidentiality and security of your personal information against loss, theft, or any unauthorized access, disclosure, reproduction, communication, use, modification, or destruction. These measures include, among others, encryption, a firewall, access control, and confidentiality commitments from our Service Providers, etc.

Despite the above measures, we cannot guarantee the absolute security of your Personal Information. If you have reasons to believe that your Personal Information is no longer protected, please contact our Privacy Officer immediately using the contact details provided in Article 2 above.

7. MODIFICATIONS TO THIS PRIVACY POLICY
